Question: Praise be to Allah, and salah and peace be upon the Messenger of Allah, and upon his family and companions.
To proceed: a question has reached me from some Pakistani brothers, the summary of which is: what is the ruling on those who call for governing by socialist and communist principles, and who fight against the rule of Islam, and what is the ruling on those who assist them in this demand, and who disparage those who call for the rule of Islam, and slander them and fabricate lies against them, and is it permissible to take these people as imams and khatibs in the mosques of the Muslims?
To proceed: a question has reached me from some Pakistani brothers, the summary of which is: what is the ruling on those who call for governing by socialist and communist principles, and who fight against the rule of Islam, and what is the ruling on those who assist them in this demand, and who disparage those who call for the rule of Islam, and slander them and fabricate lies against them, and is it permissible to take these people as imams and khatibs in the mosques of the Muslims?
Answer: All praise is due to Allah, and prayers and peace be upon the Messenger of Allah, and upon his family and companions and whoever follows his guidance. There is no doubt that it is obligatory upon the imams of the Muslims and their leaders to implement the Islamic Shariah in all their affairs, and to combat whatever opposes it. This is a matter upon which there is ijma among the scholars of Islam, with no dispute in it, praise be to Allah. The proofs for this from the Book and the sunnah are many and known to the people of knowledge, among them His saying, Glorified is He: And His saying, Mighty and Sublime is He: And His saying, exalted is He And His saying, exalted is He: And His saying, exalted is He: The verses on this meaning are numerous.
And the scholars have reached ijma that whoever claims that the ruling of other than Allah is better than the ruling of Allah, or that the guidance of other than the Messenger of Allah ﷺ better than the guidance of the Messenger ﷺ he is a kafir, just as they agreed by ijma that whoever claims that it is permissible for anyone to depart from the shariah of Muhammad ﷺ or ruling by other than it is a disbeliever gone astray. From what we have mentioned of Qur'anic evidences and the ijma of the people of knowledge, the questioner and others will know that those who call to socialism or communism or other destructive doctrines that contradict the ruling of Islam are disbelievers gone astray, more disbelieving than the Jews and Christians, because they are atheists who believe neither in Allah nor in the Last Day.
It is not permissible for any of them to be made a khatib or imam in any of the mosques of the Muslims, and salah behind them is not valid. Everyone who assists them in their misguidance, approves of what they call to, and disparages and finds fault with the callers to Islam, is a disbelieving misguided person, whose ruling is the ruling of the atheistic faction whose train he has followed and whom he has supported in their pursuit. The scholars of Islam have reached ijma that whoever backs the disbelievers against the Muslims and assists them in any way is a disbeliever like them, as Allah, glorified is He, said: And the Most High said:.
And I hope that what we have mentioned will be sufficient and convincing for the seeker of truth. Allah speaks the truth and He guides to the right path. We ask Him, glorified is He, to set right the affairs of the Muslims, to unite their word upon the truth, to humiliate the enemies of Islam, to disperse their assembly, to scatter their unity, and to spare the Muslims their evil. He is indeed capable of all things. May Allah send prayers and peace upon His servant and messenger, our Prophet Muhammad, and upon his family and companions.[1].
فَلَا وَرَبِّكَ لَا يُؤۡمِنُونَ حَتَّىٰ يُحَكِّمُوكَ فِيمَا شَجَرَ بَيۡنَهُمۡ ثُمَّ لَا يَجِدُواْ فِيٓ أَنفُسِهِمۡ حَرَجٗا مِّمَّا قَضَيۡتَ وَيُسَلِّمُواْ تَسۡلِيمٗا
But no, by your Lord, they can have no Faith, until they make you (O Muhammad) judge in all disputes between them, and find in themselves no resistance against your decisions, and accept (them) with full submission.
Qur'an 4:65 — trans. Hilali & Khan
يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓاْ أَطِيعُواْ ٱللَّهَ وَأَطِيعُواْ ٱلرَّسُولَ وَأُوْلِي ٱلۡأَمۡرِ مِنكُمۡۖ فَإِن تَنَٰزَعۡتُمۡ فِي شَيۡءٖ فَرُدُّوهُ إِلَى ٱللَّهِ وَٱلرَّسُولِ إِن كُنتُمۡ تُؤۡمِنُونَ بِٱللَّهِ وَٱلۡيَوۡمِ ٱلۡأٓخِرِۚ ذَٰلِكَ خَيۡرٞ وَأَحۡسَنُ تَأۡوِيلًا
O you who believe! Obey Allah and obey the Messenger (Muhammad), and those of you (Muslims) who are in authority. (And) if you differ in anything amongst yourselves, refer it to Allah and His Messenger (), if you believe in Allah and in the Last Day. That is better and more suitable for final determination.
Qur'an 4:59 — trans. Hilali & Khan
وَمَا ٱخۡتَلَفۡتُمۡ فِيهِ مِن شَيۡءٖ فَحُكۡمُهُۥٓ إِلَى ٱللَّهِۚ ذَٰلِكُمُ ٱللَّهُ رَبِّي عَلَيۡهِ تَوَكَّلۡتُ وَإِلَيۡهِ أُنِيبُ
And in whatsoever you differ, the decision thereof is with Allah (He is the ruling Judge). (And say O Muhammad to these polytheists:) Such is Allah, my Lord in Whom I put my trust, and to Him I turn in all of my affairs and in repentance.
Qur'an 42:10 — trans. Hilali & Khan
أَفَحُكۡمَ ٱلۡجَٰهِلِيَّةِ يَبۡغُونَۚ وَمَنۡ أَحۡسَنُ مِنَ ٱللَّهِ حُكۡمٗا لِّقَوۡمٖ يُوقِنُونَ
Do they then seek the judgement of (the Days of) Ignorance? And who is better in judgement than Allah for a people who have firm Faith.

(44) إِنَّآ أَنزَلۡنَا ٱلتَّوۡرَىٰةَ فِيهَا هُدٗى وَنُورٞۚ يَحۡكُمُ بِهَا ٱلنَّبِيُّونَ ٱلَّذِينَ أَسۡلَمُواْ لِلَّذِينَ هَادُواْ وَٱلرَّبَّٰنِيُّونَ وَٱلۡأَحۡبَارُ بِمَا ٱسۡتُحۡفِظُواْ مِن كِتَٰبِ ٱللَّهِ وَكَانُواْ عَلَيۡهِ شُهَدَآءَۚ فَلَا تَخۡشَوُاْ ٱلنَّاسَ وَٱخۡشَوۡنِ وَلَا تَشۡتَرُواْ بِـَٔايَٰتِي ثَمَنٗا قَلِيلٗاۚ وَمَن لَّمۡ يَحۡكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُوْلَٰٓئِكَ هُمُ ٱلۡكَٰفِرُونَ (45) وَكَتَبۡنَا عَلَيۡهِمۡ فِيهَآ أَنَّ ٱلنَّفۡسَ بِٱلنَّفۡسِ وَٱلۡعَيۡنَ بِٱلۡعَيۡنِ وَٱلۡأَنفَ بِٱلۡأَنفِ وَٱلۡأُذُنَ بِٱلۡأُذُنِ وَٱلسِّنَّ بِٱلسِّنِّ وَٱلۡجُرُوحَ قِصَاصٞۚ فَمَن تَصَدَّقَ بِهِۦ فَهُوَ كَفَّارَةٞ لَّهُۥۚ وَمَن لَّمۡ يَحۡكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُوْلَٰٓئِكَ هُمُ ٱلظَّٰلِمُونَ
(44) Verily, We did send down the Taurat (Torah) [to Musa (Moses)], therein was guidance and light, by which the Prophets, who submitted themselves to Allah's Will, judged the Jews. And the rabbis and the priests [too judged the Jews by the Taurat (Torah) after those Prophets] for to them was entrusted the protection of Allah's Book, and they were witnesses thereto. Therefore fear not men but fear Me (O Jews) and sell not My Verses for a miserable price. And whosoever does not judge by what Allah has revealed, such are the Kafirun (i.e. disbelievers - of a lesser degree as they do not act on Allah's Laws). (45) And We ordained therein for them: "Life for life, eye for eye, nose for nose, ear for ear, tooth for tooth, and wounds equal for equal." But if anyone remits the retaliation by way of charity, it shall be for him an expiation. And whosoever does not judge by that which Allah has revealed, such are the Zalimun (polytheists and wrong-doers - of a lesser degree).
Qur'an 5:44-45 — trans. Hilali & Khan
وَلۡيَحۡكُمۡ أَهۡلُ ٱلۡإِنجِيلِ بِمَآ أَنزَلَ ٱللَّهُ فِيهِۚ وَمَن لَّمۡ يَحۡكُم بِمَآ أَنزَلَ ٱللَّهُ فَأُوْلَٰٓئِكَ هُمُ ٱلۡفَٰسِقُونَ
Let the people of the Injeel (Gospel) judge by what Allah has revealed therein. And whosoever does not judge by what Allah has revealed (then) such (people) are the Fasiqun (the rebellious i.e. disobedient (of a lesser degree) to Allah.

۞ يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ لَا تَتَّخِذُواْ ٱلۡيَهُودَ وَٱلنَّصَٰرَىٰٓ أَوۡلِيَآءَۘ بَعۡضُهُمۡ أَوۡلِيَآءُ بَعۡضٖۚ وَمَن يَتَوَلَّهُم مِّنكُمۡ فَإِنَّهُۥ مِنۡهُمۡۗ إِنَّ ٱللَّهَ لَا يَهۡدِي ٱلۡقَوۡمَ ٱلظَّٰلِمِينَ
O you who believe! Take not the Jews and the Christians as Auliya' (friends, protectors, helpers, etc.), they are but Auliya' to one another. And if any amongst you takes them as Auliya', then surely he is one of them. Verily, Allah guides not those people who are the Zalimun (polytheists and wrong-doers and unjust).
Qur'an 5:51 — trans. Hilali & Khan
يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُواْ لَا تَتَّخِذُوٓاْ ءَابَآءَكُمۡ وَإِخۡوَٰنَكُمۡ أَوۡلِيَآءَ إِنِ ٱسۡتَحَبُّواْ ٱلۡكُفۡرَ عَلَى ٱلۡإِيمَٰنِۚ وَمَن يَتَوَلَّهُم مِّنكُمۡ فَأُوْلَٰٓئِكَ هُمُ ٱلظَّٰلِمُونَ
O you who believe! Take not for Auliya' (supporters and helpers) your fathers and your brothers if they prefer disbelief to Belief. And whoever of you does so, then he is one of the Zalimun (wrong-doers, etc.).
Qur'an 9:23 — trans. Hilali & Khan
